• Service refers to the Website, our games, mobile or desktop applications, blockchain-based platforms, and any related services (including but not limited to in-game features, digital asset interactions, and wallet connections).
• Terms and Conditions (also referred to as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
• Third-party Social Media Service means any services or content (including data, information, products, or services) provided by a third-party that may be displayed, included, or made available by the Service.
• Website refers to Cyber Horizons, Inc., accessible from https://cyberhorizons.io.
• You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

These Terms govern Your use of the Service and constitute a binding agreement between You and the Company.

By accessing or using the Service, You agree to be bound by these Terms. If You do not agree, You must not access or use the Service.

You represent and warrant that You are at least 18 years of age. The Company does not permit individuals under 18 to use the Service due to involvement with blockchain technology and digital assets.

Your use of the Service is also subject to Our Privacy Policy, which is incorporated by reference. Please read it carefully.

Blockchain and Digital Assets

The Service may allow You to connect a cryptocurrency wallet, interact with blockchain networks (e.g., Solana or others), mint, purchase, trade, or use digital assets such as NFTs, in-game items, or tokens.

You acknowledge and agree:

• All blockchain transactions are irreversible, public, and recorded permanently on the blockchain.
• You are solely responsible for the security of Your private keys, seed phrases, and wallet. The Company has no access to or control over Your wallet or funds.
• Digital assets may have no inherent value and are subject to extreme price volatility, regulatory risks, and potential total loss.
• The Company makes no guarantees regarding the functionality, value, or continued availability of any digital assets or blockchain features.
• You bear all risks associated with blockchain networks, including network congestion, gas fees, failed transactions, smart contract bugs, or hacks.

Accounts

When You create an account, You must provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of Your account credentials and for all activities under Your account.

We reserve the right to suspend or terminate accounts for any violation of these Terms.

User Conduct and Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws.
• Exploit, cheat, or use unauthorized tools/scripts to gain advantages in games.
• Reverse engineer, decompile, or attempt to extract source code from the Service.
• Interfere with or disrupt the Service or servers.
• Impersonate others or provide false information.
• Engage in any activity that harms the Company, other users, or the blockchain ecosystem.

Intellectual Property

The Service and its content (including games, artwork, code, and branding) are owned by the Company or its licensors and protected by copyright, trademark, and other laws.

You are granted a limited, non-transferable license to use the Service for personal, non-commercial purposes. Digital assets You acquire (e.g., NFTs) grant You ownership of the token but not necessarily underlying intellectual property rights, which remain with the Company unless explicitly stated otherwise.

In-App Purchases and Transactions

Certain features may involve purchases using fiat currency or cryptocurrency. All purchases are final and non-refundable, except as required by law. Transactions on blockchain are subject to network fees, which You are responsible for paying. 

Links to Other Websites

The Service may contain links to third-party sites or services (e.g., wallet providers, marketplaces, blockchain explorers). We have no control over and assume no responsibility for their content, policies, or practices.

Termination

We may terminate or suspend Your access to the Service immediately, without notice, for any reason, including breach of these Terms. Upon termination, Your right to use the Service ceases immediately.

Limitation of Liability

To the maximum extent permitted by law, the Company's total liability to You shall not exceed the amount You paid Us in the 12 months preceding any claim, or $100 if no payments were made.

In no event shall the Company or its affiliates be liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, digital assets, or goodwill, even if advised of the possibility.

We are not liable for issues arising from blockchain networks, third-party services, or Your wallet security.

Some jurisdictions limit these exclusions; in such cases, liability is limited to the fullest extent permitted.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted, secure, or error-free operation, nor that digital assets will retain value or functionality.

Governing Law

These Terms are governed by the laws of the State of Alabama, United States, without regard to conflict of laws principles.

Disputes Resolution

Any dispute shall first be attempted to be resolved informally by contacting Us. If unresolved, disputes will be resolved in the courts of Alabama.

United States Legal Compliance

You represent that You are not located in an embargoed country or on any U.S. restricted parties list.

Severability and Waiver

If any provision is invalid, the remainder remains in effect. Waiver of any breach does not constitute waiver of future breaches.

Changes to These Terms

We may update these Terms at Our discretion. Material changes will be notified via the Service or email (if provided) at least 30 days in advance where feasible.

Continued use after changes constitutes acceptance. If You disagree, cease using the Service.
